I agree with Rudin in that Denby should have honoured the contract, but I'm not exactly sure how Denby's positive review "badly damaged" the film.
EDIT: Actually, going through the comments I guess I see now; having everyone release reviews well before makes the film seem like "old news" to the public. And I can see this, since I knew someone at work he refused to see a movie that came out on video a few weeks prior because it was "old". I'm sure there's many idiots like that.

I think the gist of the problem (for the producers) is that it's not just Denby's review that will run early, but all of them, since he's effectively opened the floodgates, and why on earth would competing media outlets give the New Yorker a free pass and all the internet foot traffic? Which presumably means that the 'buzz' will appear and disperse before the audience can actually see the film. And when the film does finally open, it will be opening without accompanying reviews in many key publications.

Honestly, I've never understood embargos as anything else than trying to avoid the leaking of any early bad reviews that would prevent the movie to gross the most money it can within the first weeks.
It only looks suspicious to let journalists watch the movie a week before its release but then to prevent them to write about a movie before its release date.
If Rudin is not happy with the breaking of the umbargo date (which is, indeed, a break of contract, but anyway), he should have planned the journalists' screening just the day before the official release, not a week before.
It's just good ol' buzz and fast money grossing, and Rudin is making a fuss about it because some guy broke it and might disperse the buzz, even with a quite enthusiastic review (revealing nothing special).

The NYFCC required the early screening in order to qualify for their year-end awards. Rudin had no choice but to screen the film early if he wanted it in contention for one of the biggest Oscar precursors.

Isn't this the widespread experience of anyone who cares about films that come out in 'limited' release and doesn't live in a handful of major cities? Anyway, that Denby review is even more of a snooze than usual coming after yesterday's teapot tempest. It practically could've been written by someone who hasn't seen the film.
